Ohio’s MMCP program has established specific purchase and supply limits, referred to as Whole Day Units. These limits are outlined in the Ohio Administrative Code and vary depending on the form of medical marijuana authorized for use. Here are the defined quantities for each form:
- Dry Flower: The minimum purchase quantity for dry flower is 1/10 oz. (2.83 g) of plant material.
- Topicals: For topicals, the minimum purchase quantity is 295 mg of THC contained in a patch, lotion, cream, or ointment.
- Edibles & Tinctures: In the case of edibles and tinctures, a whole day unit is defined as 110 mg of THC contained in an oil, tincture, capsule, or edible intended for oral administration.
- Vaporization Oils: For vaporization oils, the minimum purchase quantity is 590 mg of THC contained in the oil intended for use in vaporizers.
It is important to note that a patient and their caregiver(s) are collectively required to purchase at least a whole day unit of their authorized form of medical marijuana during a single transaction. These limits ensure compliance with the regulations set forth by the MMCP program in Ohio.
90-Day Supply & 45-Day Fill Periods
According to the Ohio Administrative Code, the MMCP program sets a maximum limit on the quantity of medical marijuana that a patient, along with their caregiver(s), can purchase within a 90-day period. This Maximum limit is known as a “ninety-day supply” and is defined as follows:
A patient and their caregiver(s), collectively, are allowed to purchase, over a span of ninety days, a quantity of medical marijuana that does not exceed a ninety-day supply. It’s important to note that this ninety-day supply can consist of multiple forms of medical marijuana. However, regardless of whether it is purchased as a single form or combined across different forms, the total quantity of medical marijuanapurchased should not exceed the limit defined as a ninety-day supply.
These regulations ensure that patients and their caregivers have access to an adequate supply of medical marijuana while also maintaining adherence to the guidelines set by theMMCP program in Ohio.
90-Day Fill Periods:
A ninety-day supply is defined as follows:
- Dry Flower
- Topicals: 26. 55 grams of THC content in patches, lotions, creams, or ointments
- Edibles and Tinctures: 9.9 grams of THC content in oil, tincture, capsule, or edible form for oral administration
- Vaporization Oils: 53.1 grams of THC content in medical marijuana oil for vaporization.
45-Day Fill Periods:
The new process includes several significant highlights that patients should be aware of:
- Divided 90-day recommendation: Each patient’s 90-day recommendation is now divided into two 45-day fill periods, based on their current active recommendation. This ensures a clear timeline for patients to track their fill periods.
- Patient Fill Calculator: To determine the start and end dates for each upcoming 45-day full period, patients can utilize the Patient Fill Calculator Link provided at https://www.medicalmarijuana.ohio.gov/PatientFillCalculator. This calculator helps patients calculate the specific dates for their fill periods.
- Full 45-day supply regardless of visit date: Patients are now allowed to purchase a full 45-day supply of medical marijuana during any visit within the 45-day fill period. For instance, if a patient visits the dispensary on day 25 of the fill period and has not made any previous purchases during that period, they can still purchase up to a 45-day supply of medical marijuana.
- Waiting for new fill period: If a patient exhausts their 45-day allotment before the end of the current fill period, they must wait for the new fill period to begin before purchasing additional medical marijuana.
- No rollover between fill periods: It’s important to note that there is no rollover of unused days from one fill period to the next. For example, if a patient does not purchase any medicalmarijuana during their current 45-day fill period, they will still only be able to purchase a maximum of a 45-day supply once the next fill period begins.
These highlights aim to provide patients with a clearer understanding of the division of their 90-day recommendation, the flexibility to purchase a full 45-day supply within the fill period, and the limitations regarding rollover and additional purchases.
Terminal Illness
The program provides a variance in the 90-day supply limits for registered patients who have been diagnosed with a terminal illness. The revised limits for these patients are as follows:
- Dry Flower (plant material):
-Tier I: The limit for dry flower (plant material) is increased to 283 grams.
- Topicals:
-The limit for topicals is set at 33.3 grams of THC content, which includes patches, lotions, creams, or ointments.
- Edibles & Tinctures:
-For edibles and tinctures, the limit is set at 11.7 grams of THC content, available in oil, tincture, capsule, or edible form for oral administration.
- Vaporization Oils:
-Vaporization oils are subject to a limit of 65.7 grams of THC content in medical marijuana oil specifically designed for vaporization.
These adjusted limits are applicable to registered patients with a terminal illness, allowing them to access a higher quantity of medical marijuana within the 90-day supply period. It ensures that these patients receive adequate support in managing their symptoms and improving their quality of life during their terminal illness.
